Summary

Principle:

If you create an unfair situation → you are obligated to correct any unfair results of that situation

Problem:

Thimble corporation distributed rebate coupons, some of which had an expiration date that was too early. This created an unfair situation in which some customers mistakenly thought that the rebate offer had already expired (and so didn’t use the coupons when they actually could have).

Find or Complete the Application

The Thimble corporation created the unfair situation by distributing some coupons with a mistaken expiration date. So some people didn’t realize the coupons were actually still in effect. We can conclude that the Thimble corporation should try to correct the unfair result — they should try to make sure that the people who had the coupons with the mistaken expiration date are able to get the discount that they would have gotten if they had actually used the coupon.

The principle, if valid, most █████ ██ ███████ █████ ███ ██ ███ █████████ █████████ ██████████ ███ ████████

If a customer ████████ ████ ███ ██████████ ████ ███ ██████ ███ ███████ ███ ███ ██████ ███████ ███ ███████ ███████████ ██ ███ █████████ ██ ████ █ ██████ ██ ████ █████████

The principle allows us to conclude that the Thimble corporation has an obligation to correct the mistake. It doesn’t support a conclusion that the Thimble corporation is not obligated.

Because some customers ███ ████ ████ ████ ████ ████████ ███ ███ ██████ █████ ███ ██ █████ ███ ███ ███ ███████ ███████████ ██ ███ ██████ ███████████ ███ ████████ ███ ██████ ██████████

The principle doesn’t allow us to conclude who is or is not solely responsible for a situation. The principle is about what someone who did create an unfair situation is obligated to do.

(C) best captures what it means for the Thimble corporation to try to correct the mistake. They should try to make sure the people who had the mistakenly expired coupons get a chance to get the discount that they could have obtained had they used the coupon.

Because it cannot ████████ ███ ██ ███ █████████ ███ ████ █████████ ████████ ██ ███ █████████ ██████████ █████ ███ ███████ ███████████ ██████ ████ ███ ██████ ██ ███ ██ ███ █████████ ███ ███████ ███ ███

Denying the rebate to everyone does not constitute correcting the mistake. The unfair result is that some people who could have used the discount didn’t get to use it (because they thought their coupon had expired). So let’s make sure they get to have the discount, too. The unfair result is NOT about other people getting the discount.

The principle allows us to conclude that the Thimble corporation has an obligation to correct the mistake. It doesn’t support a conclusion that the Thimble corporation is not obligated.
