Bentham's Solution ·Inclusion is the rule, exclusion is the exception
If relevant, then include. Narrow exceptions made for exclusion. Flips the status quo of evidence law (exclusion rule, inclusion exception) on its head.
Example ·Evidence of defendant's past bank robberies
Sure, it's relevant. But it also prejudices the jury (meaning it makes jury think that being a bank-robber is in his character) and so hurts the jury's ability to decide correctly in this case.
Problem / Critique ·Bentham's exceptions are inconsistently applied
Bentham concedes that there can be other values more important than admitting relevant evidence. That's why he excludes sacramental confessions. Okay, but that same reason should also apply to exclude other privileged communications.
Despite the concerns raise, Bentham's idea of admitting evidence by default and excluding evidence only when there are clear reasons for doing so is now the standard.

Purpose of passage
In this passage, the author describes Bentham’s proposed solution to the confusing and irrational evidence laws. She also offers light criticism of Bentham’s solution. The primary purpose should be related to presenting Bentham’s solution and offering some criticism of it.
a
suggesting the advantages ███ ███████████ ██ █ █████ ██████
This best captures the author’s purpose. She describes the advantages of Bentham’s proposed reform but also describes some limits to it in P4.
b
summarizing certain deficiencies ██ ██ ████████ █████ ██████
Evidence laws are not a “legal system.” So even if the author describes deficiencies of old evidence laws, that isn’t the same as describing deficiencies of an outmoded legal system. In any case, (B) doesn’t capture the passage’s focus on Bentham’s proposed reform.
c
justifying the apparent ████████████ ██ ███████ ████████ ███
The passage doesn’t focus on inadequacies of current evidence law. Rather, it focuses on Bentham’s proposed solution to the inadequacies of 18th-century evidence law.
d
detailing objections to ███ ████████████ █████████
Although the author does offer some criticism of Bentham’s nonexclusion principle in P4, (D) doesn’t capture the purpose of the overall passage. The passage overall does not focus on criticism of Bentham’s principle. Rather, it also discusses the reasoning underlying it as well as its influence on modern law.
The author doesn’t advocate that we should reexamine something that has been dismissed by the legal profession.
