The rules (on the admission tickets) say that you can’t leave to use the bathroom after you check in until section one of the test starts. The proctor was correct, so I wouldn’t want to tell law schools about it.
I would say retake if Logic Games was holding you back. In onemonth, you can probably get close to -0 with the fool-proof method. Also mention your concussion in your addendum since that's a legitimate reason for your under-performance.
One thing that I would recommend (as someone who took September and is also retaking in November) is to make sure that you’re PTing under strict conditions. No extra time for bubbling, use a scantron sheet, take at least one 5 section test
