I just did this game. It's because it is an inoutgame and JY is using the Appellate Court as the in group and the Trial court as the out group. So if H is not in T, that means he's in A which is the in group. Hope that helps!

Yea PT26.S1.Game 4 is a difficult In/Outgame. I've done this so many times! (same, @"Leah M B"!) Let us know if there's any part of JY's video that you don't understand.
